Dying Without a Will in Montana

Survivors are grandchildren only.

Assume you pass away without a written will. All of your children have predeceased you. Your assets are divided equally among your six grandchildren, 1/6 to each. This is called a per capita division.

If this is not the division you desire, then you need to write a will.
